Algerian Organic Media Law 2023: A Critical reading to the amendments and the extent of their adaptation to modern requirements for media and press

This study sought to attempt to dismantle, read and explain the articles of the Organic Media Law of 2023, which is the first amending law since 2012, with the aim of identifying the additions and amendments it brought, and the extent to which it keeps pace with developments taking place in the media field, such as technological developments, as well as revealing its strengths and shortcomings compared to its predecessors.
Through criticism and analysis, we concluded that the legislative charters under study included many of its articles in anticipation of regulatory laws expected in the future, which carry with them many questions. In addition to that, we maintain the advantage of abolishing the prison sentence for press misdemeanors approved by the Media Law of 2012, as it is considered an important step in consecrating the citizen’s right to objective and multimedia media. On the other hand, it is considered an important gain in the establishment of newspapers and magazines, which rely on permission only, without waiting for approval from the Ministry of Communications.
